In Sweden, it is the parliament, (Riksdag) chosen by general elections who determines the laws, regulations and the foreign policy.
The right for a foreigner to stay in the country is governed by the Aliens act.
The government administrates the decisions taken by the parliament in democratic order. Authorities as theSwedish Migration Agency are required to act in accordance with the decisions taken by the government and the parliament.
As for individual asylum seekers it is the Swedish Migration Agency who tries the cases in first instance. If the application is rejected, it can be appealed. The case will then be tried in the Migration court, who independently from the Migration Agency will examine the case.
A decision from the Migration Court can be appealed to the Migration Court of Appeal who will only examine a few selected cases in which the decision may have an impact on the interpretation of the Aliens act.
